(i) All Bookings are subject to the terms and conditions set out below (the ‘Terms and Conditions’). The Terms and Conditions may only be varied as agreed in writing by Three Piece Events Ltd.
(ii) The terms defined in the Quote shall also apply to these Terms and Conditions. The following definitions shall also apply:
(a) ‘Booking’ means the Event booked by you under the Quote and the Terms and Conditions;
(b) ‘Enquiry’ means an event enquiry made by you to Three Piece by submitting your Event Details via the website, email, social media platform or phone;
(c) ‘Event Details’ means the information provided by you in order for Three Piece to Quote your Event;
(d) ‘Quote’ means the price and details of the Event as confirmed by Three Piece;
(e) ‘Agreement’ means the Quote Contract and Terms and Conditions;
(f) ‘Three Piece’ means Three Piece Events Ltd Company;
(g) ‘You’ means the Client, as defined in the Event Details.
(h) ‘Minimum Spend’ means the lowest sum required to qualify.
(iii) In order to make an Enquiry you should provide Three Piece with the correc information about your Event Details, to the best of your knowledge.
(iv) Upon receipt of the Event Details Three Piece will confirm its availability and provide you with a Quote, confirming the details of the Event as agreed between you and Three Piece, and a copy of these Terms and Conditions.
(v) Three Piece will reserve the date of the Event as specified in the Event Details. If Three Piece has not received the Deposit and a signed copy of the Quote Contract, they reserve the right to release the date to other potential clients.
(vi) Upon receipt of the Deposit and a signed copy of the Quote, Three Piece will confirm your Enquiry as a Booking.
(a) the minimum Deposit required for a Booking between January 1st and November 30th is 50% of the value of total Quote.
(b) the minimum Deposit required for a Booking between December 1st and December 31st is £1000 inc VAT.
(vii) You may request to make a change to your Booking at any time up to 1 week prior to the Event by giving notice in writing of such proposed change to Three Piece. The proposed change must be approved in writing by Three Piece. Any change to your Booking may result in an increase in the Hire Charge, however Three Piece will inform you of any Hire Charge increase before confirming any proposed change.
(viii) Three Piece reserves the right to refuse any proposed change to your Booking.
(ix) You must inform Three Piece of the final number of guests who will attend the Event at least 1 week prior to the Event, unless otherwise agreed with Three Piece. If the final number of guests who will attend the Event is different to that agreed in the Event Details, Three Piece reserve the right to increase the Hire Charge as necessary.
(x) All payments are to be made to: Three Piece Events Ltd, Account number 41693026, Sort code 40-24-07.
(xi) Three Piece must receive full payment, as specified in the Event Details, at least 2 weeks prior to the Event unless otherwise agreed. Cash, bank transfer and company cheques (if provided with a covering letter signed by an authorised representative of the Client) are accepted.
(xii) If Three Piece approve any proposed change to the Booking in accordance with Clause (vi), or a change to the number of guests under Clause (viii), Three Piece reserves the right to increase the Hire Charge and amend the value of the final invoice.
(xiii) If, after you have made full payment of the Hire Charge, Three Piece approves any proposed change to the Booking resulting in an increase to the Hire Charge, any increase amount shall be due at least 48 hours prior to the Event.
(xiv) VAT is applicable to all charges.
(xv) Notwithstanding the above, and unless otherwise expressly stated, all charges shall be paid within 14 days of receipt of an invoice from Three Piece specifying the amount due.
(xvi) If a person other than the Client is responsible for payment of the charges, the Client must notify Three Piece when making the Booking and supply the Owner with direct contact details.
(xvii) If you wish to cancel your Booking prior to the Event, you must give notice in writing to Three Piece.
(xviii)If you give notice to cancel your Booking:
(a) more than 1 year (365 days) before the Event date, Three Piece will refund You the amount already paid, less a cancellation fee equal to 10% of the Quote.
(b) less than 1 year (365 days) before the Event date, Three Piece will retain any monies paid.
(xix) Three Piece reserves the right to cancel your Booking at its sole and absolute discretion by providing notice in writing to the Client in the following circumstances:
(a) if, prior to the Event, Three Piece reasonably considers that the nature of the Event is substantially different from the nature declared by You when the Booking was made. In these circumstances, your Booking will be treated as though it were cancelled under Clause (xviii)(b);
(b) if, prior to the Event, Three Piece become aware of any deterioration in your financial situation such that Three Piece reasonably considers that you will be unable to fulfil its payment obligations under the Agreement. In these circumstances, your Booking will be treated as though it were cancelled under Clause (xviii)(b); and
(c) if Three Piece is unable to carry out any of its obligations under the Agreement due to circumstances beyond its reasonable control. In these circumstances, you will be entitled to a full refund of any monies paid.
(xx) Three Piece enforces a challenge 25 policy and reserves the right to refuse service if the policy requirements are not met.
(xxx) A suitable door policy for the Event shall be agreed in writing between you and Three Piece at least 1 week before the Event.
(xxix) Subject to your compliance with your obligations under the Agreement, Three Piece agrees to:
(a) provide the services specified in the Quote or as otherwise agreed between the parties in writing; and
(b) provide adequate staffing for the Booking.
(xxiix) Wines, beers, spirits and other consumables are subject to availability and Three Piece reserves the right to provide alternative wine, beers spirits and other consumables at the Event without giving notice to the Client.
(xxiv) You agree to:
(a) ensure that no damage is caused to the property of Three Piece at the Event;
(b) ensure that your guests do not enter any area of the Venue that is allocated to Three Piece for the Event;
(c) allow Three Piece and its employees access to any and all areas used by you during the Event; and
(d) not obstruct the parameters of the Venue which are reserved rights of way for fire escapes, or do anything which would reasonably be deemed to cause an increased risk in the occurrence of a fire or affect the safety of all persons in or about the Venue.
(xxv) Three Piece reserves the right to refuse service to any visitor or guest who in its reasonable opinion is:
(a) under the influence of alcohol, displaying signs of being a danger to themselves or others due to the influence of alcohol;
(b) under the influence of illegal drugs, or displaying signs of taking or dealing drugs at the Event;
(c) verbally or physically offensive towards any person present; or
(d) under the age of 18 years old.
(xxvi) cash & card bar services have the following requirements:
(a) a TEN (temporary event notice) to be submitted to the local council, by Three Piece, at least 10 working days before the event. You are responsible for the cost of £21, payable to Three Piece by invoice.
(b) a Deposit of £15 per guest.
(c) a Minimum Spend of £30 per adult and £10 per child. If the Minimum Spend is met, the Deposit is refunded. If the Minimum Spend is not met, Three Piece will refund You the difference. If the Deposit does not cover the difference, You are liable to settle the outstanding balance.
(d)Three Piece reserve the right to deduct the cost of any and all damage to company property from your Deposit.
(e) Three Piece enforce a late fee of 25%.
(xxvii) You shall pay Three Piece for the cost of repairing any damage to the
property of Three Piece where such damage was caused by you or any Event guest on the Event premises, along with any loss of earnings incurred by Three Piece as a result of said damage or disruption to the property.
(xxviii) Three Piece’s liability will be limited to 100% of the charges paid or payable by you under the Agreement.
(xxix) Three Piece will not be liable for any loss, damage or injury to your property, or the property of any Event guest or other persons for whom you are responsible.
(xxx) Three Piece will not be liable for any delay or failure to perform its
obligations under this Booking, or any loss suffered by you if such delay, failure or loss is due to circumstances beyond its reasonable control.
(xxx) Nothing in this Agreement excludes or limits either party’s liability for death or personal injury caused by its negligence or for fraud.
(xxxii) Any notices to be given under this Agreement must be made in writing and delivered by post or email to the address specified in the Event Details.
(xxxiii) You are not permitted to assign any of your rights and obligations under this Agreement without the prior written consent of Three Piece, such consent not to be unreasonably withheld.
(xxxiv) The parties do not intend any third party to have the right to enforce any provision of the Agreement under the Contracts (Rights of Third Parties) Act 1999.
(xxxv) The Agreement and any non-contractual obligations arising under it will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.
